The Next New Power Grab

The Obama Administration is pursuing perhaps its biggest power grab yet. Climate Czar Carol Browner is trying to have the EPA regulate carbon dioxide as a pollutant under the 1970 Clean Air Act, a sweeping global warming regulatory agenda without a vote of Congress.

Their biggest problem is the law. The 1970 Clean Air Act clearly does not allow them to regulate the way they want. If the EPA insists on shoehorning greenhouse gas regulation into the 1970 Clean Air Act, the result will be regulation of millions of businesses, warehouses, and even schools. Instead, they want to create new rules pretending the law says something it doesn't.

They call it the "tailoring rule," because they are attempting to tailor their regulations to just the particular industries they want to regulate. Even worse, the tailoring rule is unlikely to be effective, instead opening up a floodgate of regulations from state regulators and judges who will not be bound by the EPA rule. They will be free to regulate everything that moves and lots of things that don't.

In addition, you should contact your representatives in Congress and tell them we pay members of the House and Senate to make laws, NOT the EPA. Tell them to start doing their jobs and take on the EPA, instead of rolling over and playing dead. Ask them who works for whom. Tell them if they don't do their jobs, next year you'll replace them with someone who will.

  1. This is utterly ridiculous. Its just like Democrats to use short-cuts to bypass actual law. They certainly are the most power hungry individuals who will do anything, including use illegal means, to achieve their ends.

  2. Yes, the Dems love to do this but it's also the Obama administration who is pushing this, so O'Blah-Blah can tell the Heads of State in Copenhagen we are on board, as he bows & scrapes and grovels for acceptance.
